It is due to the secularization of the model of divine legislation that statutory law has been seen as a species of command (John Austin) issued by an unrestrained commander. Roman and Civil Law have maintained the classical tradition that statutory law presupposes necessarily, for its authorization, limitation and object, a preexisting legal order.
