The interests of an author are protected by fundamental law, which is limited by certain rules of the copyright law. The legislator imposes such limitations for socio-political reasons and to protect the legitimate interests of the public. The development of digital technology in publishing original material poses a challenge for the legal system in balancing the interests of the user against protecting authors of copyright material. To achieve a reasonable balance between these competing interests the copyright limitations must be interpreted fairly. Therefore the basic rights under constitutional law and the Three-Step Test from the Harmonization Directive 2001/29/EEG are of vital importance.
This paper considers the limitation and how these should be interpreted, and offers a guide for interpretation in line with constitutional requirements and the Three-Step Test. Finally, this paper will analyse § 52b UrhG (a rule for dedicated terminals digitising copyright material in public libraries, museums and archives). The requirements of § 52b UrhG are examined in detail as well as how such electronic terminals should comply with the constitutional law and Three-Step Test.
