Sporting events and the marketing thereof has significant commercial value. Constructing licence agreements that fit the needs of both the licensor and the licensee is nevertheless quite complicated. Neither the German civil law directly nor the German Federal Court of Justice grant the organizer of the event an intellectual property right for his work. Consequently the right to exploit the sporting events audiovisually can only originate from the license agreement. But this construction does not provide the licensor with the protection he needs. Especially as regards infringements from third parties, it does not give the licensor sufficient means to take care of his interests. This book offers a solution to this as it shows a new way of marketing sporting events by using the broadcast material as subject matter of the contracts.
