The Political Parties Act is per se constitutive for public will-formation – as it is for the political parties themselves. It is therefore all the more suprising to learn that for almost two decades political parties in Germany were founded, and participated in public will-formation and elections, without the existence of a Political Parties Act. It was only enacted after the German legislature was forced to do so by a decision of the German Constitutional Court. On the 24th June, 1967 the West German Bundestag passed the first Political Parties Act in German history. In addition to general provisions, this Act also contained detailed provisions on, for instance, state party financing, for the first time.
The present conference volume comprises papers delivered by selected experts at a symposium held in September 2008 on the occasion of the 40th anniversary of the Political Parties Act. The papers shed light on core aspects of the Act. In addition it documents a discussion forum of party treasurers on the practicability of the Act.
