The dissertation deals with a lot of questions, which are relevant as well for the environmental criminal law as for the establishment criminal law.
Often environmental criminal actions are commited by companies. To prosecute these companies it is difficult for the enforcement authorities, but at the same time there is an increasing risk of criminal liability for the company members. A good solution for both parties could be a transfer of the EMAS-system. A fundamental element of this system is a voluntairy co-operation of companies for a community system for environmental management and an environmental management check.
In the centre of this dissertation is the question, if and in which dimention the EMAS-System will be a relief for the environmental law for companies. Beyond that the issue of further possitive as well as negative penal impacts of EMAS will be treated.
